Defendants get prison time

District Attorney Greg Newman announced the following case dispositions from Superior Court terms in Polk, Transylvania and Henderson counties:

In Henderson County:

  • James Loughery of 53 Sweet Pea Lane, Hendersonville, pleaded guilty to Breaking and Entering a Motor Vehicle and was sentenced to 17 months in prison;
  • James Pruitt, Jr. of 109 Hall Street, Hendersonville, pleaded guilty to Habitual Impaired Driving and was sentenced to prison to 31 months;
  • Arnold Sims of 201 Powell Mill Road, Spartanburg, SC, pleaded guilty to Obtaining Property by False Pretenses and sentenced to prison to 14 months;
  • Jimmy Taylor of 414 Old Hendersonville Road, Fletcher, pleaded guilty to Assault on a Child under 12 years of age and was given a 45-day jail sentence.

In Transylvania County:

  • Andrew Bryson of 522 Long Shoals Road, Arden, pleaded guilty to Assault with a Deadly Weapon Inflicting Serious Injury and was sentenced to prison for 52 months.
  • Daniel Butler of 330 Sutton Creek Road, Pisgah Forest, NC, pleaded guilty to Possession with the Intent to Sell or Deliver a Schedule II Controlled Substance and was sentenced to 20 months in prison and  was given an additional 15 months in prison for violating the terms of probation in a previous conviction.

In Polk County, Lucas Denton Scoggins, of 325 John High Road, Campobello, S.C., pleaded guilty to DWI and was given an active prison sentence of 12 months.

Newman opposed three petitions for removal from the North Carolina Sex Offender Registry.

Superior Court Judge Mark Powell denied the petition filed by Sam McKinney of 32 Flat Creek Road, Weaverville; withheld a ruling on a petition by Mary Wiggins of 138 East Oak Hill Court, Flat Rock, pending further information from the petitioner; and agreed to a petition filed by Daniel Kuykendall of 51 Princess Place, East Flat Rock, to have his name removed from the registry.

Powell was the presiding judge in all cases.
