UNDER AND BY virtue of
the power and authority contained in that certain Deed of Trust executed and delivered by Jeffrey B. Shipman Enterprises, Inc., dated August 28, 2020, and recorded in the Office of the Register of Deeds for Henderson County, North Carolina, in Book of Record 3552, Page 366, and because of default in the payment of the indebtedness thereby secured and failure to carry out or perform the stipulations and agreements therein contained and pursuant to the demand of the owners and holders of the indebtedness secured by said Deed of Trust, and pursuant to the Order of the Clerk of Superior Court for Henderson County, North Carolina, entered in this foreclosure proceeding, the undersigned Trustee will expose for sale at public auction on the 15th day of October, 2025 at 10:00 AM., on the steps of the Henderson County Courthouse, Hendersonville, North Carolina, the following described real property (including all improvements thereon):

BEING all of that I I .900 acre tract depicted on plat of record at Plat Slide 8500 in the office of the Register of Deeds for Henderson County, North Carolina reference to which plat is hereby made for a more particular description and also being more particularly described as follows:

Beginning at an 1 inch existing iron pipe in the eastern margin of the right of way of US 176 (Spartanburg Highway) at the southwest corner of property now or formerly acquired by Kirpatrick in Deed Book 1360 at page 488, of the Henderson County North Carolina Register of Deeds Office "Registry", said pipe also being located South 30 degrees 42 minutes 57 seconds East 5,326.23 feet from NCGS Monument "Bonclarken" located N=572,918.93 and E=980, 182.58 with a combined factor of 0.99977334 (Ground to Grid), running thence from said Beginning point and with the southern line of Kirkpatrick North 85 degrees 57 minutes 07 seconds East 280.95 feet to a % inch existing iron pipe and North 46 degrees 55 minutes 09 seconds East 75.08 feet to an I inch existing iron pipe, being the southeast corner of Kirkpatrick and the southwest corner of property now or formerly acquired by Kirkpatrick in Deed Book 1349 page 465 of the Registry, thence with the southern and eastern line of Kirkpatrick, South 88 degrees 49 minutes 29 seconds East 33.99 feet to a % inch existing iron pipe, South 80 degrees 51 minutes 56 seconds East 60.11 feet to a % inch existing iron pipe and North 9 degrees 03 minutes 28 seconds East 137.92 feet to a 5/8 inch existing iron stake located in the southern boundary of property now or formerly acquired by Sizemore in Deed Book 1413 page 666 of the Registry, thence with the southern line of Sizemore South 69 degrees 55 minutes 47 seconds East 191.07 feet to a 5/8 existing iron stake in the western margin of the right of way of an exit ramp off US Highway 25 and a fence, then the following four calls with the said exit ramp and fence: South 6 degrees 47 minutes 24 seconds West 98. I I feet to a right of way monument, then on a curve to the right with a radius of 3719.72 feet, an arc length of 1104.20 feet and a chord bearing and distance of South 15 degrees 17 minutes 35 seconds West 1100.15 feet to a right of way monument, then on a curve to the right with a radius of 435.46 feet, an arc length of 257.69 feet and a chord bearing and distance of South 40 degrees 50 minutes 06 seconds West 253.94 feet to a right of way monument and South 57 degrees 46 minutes 42 seconds West 56.75 feet to a point at the intersection of the exit ramp, a fence and the eastern margin of the right of way of US 176 (Spartanburg Highway), thence the following five calls with the eastern margin of the right of way of US 176 and partway with a fence: North 3 degrees 17 minutes 21 seconds West 611.43 feet to an h inch iron pin set, thence on a curve to the left with a radius of 1 1529.16 feet, an arc length of 396.94 feet and a chord bearing and distance of North 4 degrees 13 minutes 46 seconds West 396.92 feet to a right of way monument, thence on a curve to the left with a radius of 1 1529.16 feet, an arc length of 50.62 feet and a chord bearing and distance of North 5 degrees 20 minutes 29 seconds West 50.62 feet to a 1/2 inch iron pin set, thence South 47 degrees 47 minutes 40 seconds
West 31.82 feet to a right of way monument and North 5 degrees 37 minutes 58 seconds West 215.25 feet to the point and place of Beginning, containing I I .93 acres more or less. Being the property on a survey prepared by Cameron S. Baker, Professional Land Surveyor of Associated Land Surveyors dated April 14, 2020, Job number S-20-130, reference to said survey being made for further description.

ALSO BEING all of that real property described in deed of record in Book of Record 3552, Page 363, in the office of the Register of Deeds for Henderson County, North Carolina and being identified within the tax records for Henderson County, North Carolina by Real Estate Identification number 1014570.

The sale will be made subject to: (a) all prior liens, encumbrances, easements, right-of-ways, restrictive covenants, or other restrictions of record affecting the property; (b) property taxes and assessments for the year in which the sale occurs, as well as any prior years; O federal tax liens with respect to which proper notice was not given to the Internal Revenue Service; and (d) federal tax liens to which proper notice was given to the Internal Revenue Service and to which the right of redemption applies.

The property is sold "as is." Neither the beneficiaries of the deed of trust, nor the undersigned Trustee, make any warranties or representations concerning the property, including but not limited to, the physical or environmental condition of the property. Further, the undersigned Substitute Trustee makes no title warranties with respect to the title to the property.

The highest bidder will be responsible for payment of the revenue stamps payable to the Register of Deeds and any final court and/or audit fees payable to the Clerk of Superior Court which are assessed on the high bid resulting from this foreclosure sale.
The record owner of the above described real property as reflected on the records of the Henderson County Register of Deeds not more than ten days prior to the posting of this Notice is Jeffrey B. Shipman Enterprises, Inc.

An order for possession of the property being sold may be issued pursuant to N.C.G.S. 545-21.29.

Pursuant to North Carolina General Statute 45-21.10(b), any successful bidder will be required to deposit with the Trustee immediately upon conclusion of the sale a cash deposit of five (05) percent of the bid, up to and including $750.00. Any successful bidder shall be required to tender the full balance purchase price so bid in cash or certified funds at the time the Trustee tenders to bidder a deed for the property or attempts to tender such deed, and should said successful bidder fail to pay the full balance purchase price so bid at that time, bidder shall remain liable on bidder's bid as provided for in North Carolina General Statute 45-21.30.

This sale will be held open ten (10) days for upset bids as required by law.
